Yes we all pay our ISP. However, if someone is posting Melonie Charm's photos and giving away for free, what she makes her living selling, then that is not only wrong it is illegal. I will never outgrow that feeling.  

Melonie needs to be made aware of who is stealing from her, or if she has licensed them the photos, why she stopped providing them new material.

Well, original questio was: If someone can post here a couple of recent pictures of Melonie Charm ? Made, say 2-3-10 days ago ? That's all. I don't ask about anything else. And especially I don't have any intention to discuss any matters of legality or of illegality of any actions of Internet-providers. Because this is a fact and there is no possibility to change the situation. Most of russian Internet-providers don't have any obligations, as concerned any distrubution or use of foreign graphic (etc.) materials. As also there is no possibility ot prove that these materials are used to bring them some add.money. This is like, say, Usenet news-groups. The same situation.

This is a problem of your age. As I wrote it before. I'm 99,9% sure that your point of view will change one day. Because the rest (0,1%) - this is already a kind of pathology. More free pictures of MC are distributed via Internet - more popular she'll get. The same is for efficiency of her business.

I will leave it to Melonie to comment on how your twisted morality and her photos collide.  You steal and refuse to pay so it will help melonie advertise herself?  Her advertising and image distribution should be left up to her, not the likes of you.

Regarding "fair use for promotion" issues - I don't see how posting an entire photoset in full quality makes someone feel more inclined to buy that very same photoset.  One or two pics, or a few in reduced quality - that I can understand (although that's also a copyright violation in legal terms).

As for russian ISP's being protected by russian law, I'm not buying that for a second.  Russia has signed UN conventions on copyright laws just like anyone else.  Any american work is entitled to the same protection under russian law as a russian work.

The reason why people tend to take a hostile stance towards you is your open disrespect for Melonie, a much liked member of this board, and also your failure to realize why this reflects badly on the image of this site as a whole.  See, if you want to download stolen pics noone here can stop you, but try not to boast about it, will you?

Some data to explain why this happens in Russia and why Shadowcom probably has this mind set.


As you probably know Russia went communist (or actually not truely communist as they had an oppressive elite which is not really communism as communism should be voluntary and really a mind set more than something that is imposed.) Then the Russians went and decided that they would be generous and donate this system to surrounding countries. By force of course. So what you got was basically most things done for you and in return you had no right to say anything. Well you could say something and end up at a gulag. Enter the breakdown of the system.

Suddenly peeps had to fend for themselves, sure they had free speech but they started to run out of everything. Hmm. What a perfect opportunity for unscrupulous operators not to speak of crime (Read stuff like russian mafia).

Hey. We have a new mind set. Survival of the fitest, dog-eat-dog and all sorts of wonderful things like that. Now then. This has been going on since when? Sometime in the 80's from memory. Long enough so that the younger peeps have grown up much more crime oriented than absolutely necessary. From this we get products like Shadowcom.


Hence why he feels no legal or moral quams about anything crime oriented.

How is it that I know stuff like this? Because I was kept in the loop about it due to the fact that my dad was born in one of the countries forcibly integrated into the Russia communist system.  What do I mean by forcibly? Lets say for example way back in the early 30's when there was a need to get fast money to get an industrial economy going. How it was done was that all the grain was taken from a country to sell for money to do this. So that in but one year around 10 million peeps died from starvation. It is reasons like this that I had no great regard for that particular system of government.

Well, I've held off in responding to this thread in order to see just how bizarre the comments might become ! But now that we're at the verge of debating the difference between capitalism and communist remnants it's time to pipe in.

#1 - If you must know, my mother has had chronic health problems for the past year or two.  She has been admitted and released from the hospital several times in the past few months.  As she is now an invalid, and because she depends on me for daily care (my Respiratory Therapist training certainly came in handy administering daily IV antibiotic injections into the Arterial Port her doctors installed), I have not been able to make any major travel or schedule commitments since last September when her relapse occurred.  In fact I do have several new photo layouts in the 'can', but have not had the time to sit down, tweak the images, and post them to my website.  Members of my website are aware of the situation with my mother's medical condition, and have been very understanding in this regard (which I greatly appreciate).  In the interest of these members, perhaps I'll impose on my web guru SteveF to take the time which I don't have to tweak the new pics and post them on my behalf.

#2 - The subject of "fresh pics", i.e. pics shot in the chronologically recent past versus pics shot en masse in one session but then posted gradually over a period of several months, is one which I have previously voiced my opinion about.  In fact this was one of the reasons I chose to sever my relationship with Photoclubs, as they routinely pay their models a one time fee, shoot hundreds of pics during a single photo session, and then post a portion of these pics bi-weekly over a period of the next several months.  As also pointed out, magazines such as SCORE often shoot several photo sets during a model's visit to their studio, which may not actually be published in the magazine until months or even years later.  As nobody seems to complain about these practices where other big bust models are involved, I felt that it was safe to resort to the same procedure temporarily due to the time demands my mother's condition now places upon me.

#3 - as far as the enforcement of copyrights in former Communist Block countries, my only "real world" response to this issue is the well known New York expression "fuggedaboudit".  Yes, websites and other media in these countries routinely pirate material, profit from its redistribution, and don't even bother informing the original model let alone paying her anything.  Actually, pirated pics from my website is nowhere near the top of the list in this regard - I actually discovered that I am apparently considered somewhat of a cult figure on Yugoslavian TV, as European fans have informed me that one of my videos has made the rounds in a 3am timeslot or something.  It is true that eastern European media and websites apparently do not feel they are obligated to provide any further payment to a model if SOMEONE has originally paid for the material, but country-wide rebroadcast of a video which one person paid me $29 for does seem to be taking the "sharing with your comrades" principle a bit far for a capitalist mind to absorb.  As far as legal recourse, again, "fuggedaboudit".  You can imagine the costs and risks involved in attempting to ascertain exactly which person in exactly which eastern european country was responsible for the republication of copyrighted material, let alone attempting to get eastern european law enforcement agencies to take action against a "comrade" based on the word of a "capitalist" - particularly when adult material is involved.

#4 - In regard to retirement plans, the thought occasionally crosses my mind.  These occasions often co-incide with incidents where my hard work as a big bust model results in enduring insults and/or financial loss.  As a matter of fact, it just so happens that the $750 annual renewal fee for my website's ability to process MasterCard and Visa charges in 2004 is about to rear its ugly head.  Given the actual profit margin of my website after hosting fees and bandwidth charges, plus this $750 fee coming due in the very near future, plus the time demands placed upon me by my mother's condition, the thought has briefly crossed my mind to shut down my website, save the $750 fee, and concentrate my efforts on my IFriends WebCam site and modeling for large multi-girl big boob websites in exchange for a fixed modeling fee.  Of course if I were to do this, it would be extremely bad for the profitability of eastern european pirate sites such as the one Shadow patronizes (or maybe not, they'd just pirate the images from the multi-girl big boob websites, but at least it would then be their financial loss and not mine) !

.... and guys actually wonder why there are so few new big bust models entering the business !!!!!

You could probably sue and win or settle against the TV channels and the ISP's, although I guess it might be hard to take on something like that given your present preoccupation.  There is no way that such a reposting or broadcasting could be legal over there, even if they paid a few bucks for it.  A TV channel is certainly a target big enough to be worthwhile going after, as long as you can get the legal help you might need.  Broadcasting licenses are expensive.

What broadcasting licenses ?  You're talking about a former state-owned enterprise here.  Who would I sue ?  Would you care to take a guess at the amount of money it would cost me to even begin to investigate the particulars ?  We're not talking about a country (and I'm not even sure which specific country is involved now, Serbia, Croatia ?) with a long history of capitalism and justice here!  People who 'make waves' over such matters often wind up being 'drowned' in the process - just ask the Russian Oil Billionaire who was recently imprisoned for claiming his due profits!  And he had billions at his disposal, while I'd be hard pressed to cover the cost of a plane ticket to Serbia if I actually had the time available to go and attempt to pursue this matter.
